Wellington Bake Club 2011 Terms and Conditions

Information on how to enter the Promotion forms part of these Terms and Conditions. Entries not made in accordance with these Terms and Conditions will be disqualified.

Section 1: Promotion

1. Promoter: Foodstuffs (Wellington) Co-operative Society Ltd. PO Box 38896 Wellington Mail Centre, and Positively Wellington Tourism. PO Box 10 017, Wellington 6011, and Grow Wellington. PO Box 10 347, Wellington 6143

2. Promotion Period: The Promotion will commence at 9:00 am (NZDT) on 13 June 2011 and will close at 11:59 pm (NZT) on 18 August 2011.

Section 2: Eligibility

4. Eligibility: To be eligible to enter the Promotion the entrant must:

(i)          Be above 18 years of age; or have parental permission to take part, and

(ii)        Must be a New Zealand resident

5. Non-Eligibility:  Entrants are not eligible to win any Prize if they are a director, manager, an employee or immediate family member of an employee of the Promoter or are an employee of any of the agencies directly associated with this Promotion.

6. Incorrect contact details:  Further, if any contact details provided are incorrect, the entrant is not eligible to enter the Promotion.

Section 3: Entry to the Promotion

7. For any entry to be valid

(i)          Register by 5pm Wednesday 13 July (only one registration per club required); and

(ii)        Be part of a Bake Club with at least four members (there is no maximum limit on the number of bakers per club), and a baker may be part of as many clubs as they wish; and

(iii)       Everyone in the Bake Club must bake on the same day once a week for three weeks (the club determines the Bake Day best suited to the members). If a Bake Club member misses a Bake Day, it is up to the Bake Master to decide if they will change the system to a highest average rate (giving the missing member no disadvantage); and

(iv)      If successful in being in the top two bakers in their club, the baker must bake again in week four; and

(v)        If they are the final representative, they must attend the Bake Off with the predetermined baking product to be judged; and

(vi)      Baking must be baked by the bake club member, and not purchased and/or made by another person.

Section 4: Judging

8. Judging:

(vii)     The Prize Winner will be the baker with the most highly scored baking as scored by a panel of judges chosen by the Promoter at the Wellington Bake Off 2011 on Thursday 18 August.

(viii)   Baking is judged on taste, appearance, flavour, and inclusion of ingredients produced in Wellington (a minimum of one ingredient produced in Wellington is required per bake).

(ix)     The judges' decision is final, and no correspondence will be entered into.

(x)        If any Prize Winner is not able to take the prize for any reason the prize will be forfeited and a new winner chosen.

Section 5: Prize

9. Number of Prizes: There will be 1 major prize. The Prize is set out in Clauses 9 and 10.

10. Prize Value: The total Prize value is up to NZD $4,500 (inclusive of GST).

11.  Major Prize: The major prize awarded to the winner will either consist of:

  • $1000 worth of groceries from New World;
  • A Fisher & Paykel appliance to the value of $2500 (including GST) for the Bake Club; and
  • $1000 worth of bake ware from Kirkcaldie & Stains.

12.  Prize Conditions: The Prize is subject to the following conditions:

(a)   No exchange of Prize: The Prize in its entirety cannot be transferred to another person. It cannot be exchanged or redeemed for cash.  If for any reason, the Prize Winner cannot take the Prize then the Prize will be forfeited.

(b)   Ancillary Costs: Any costs in excess of the value of the Prize and all ancillary costs above the stated travel costs and accommodation are not included in the Prize and are the responsibility of the Prize Winner.

(c)  Taxes: There is no tax applicable to the prize value.

(d)   Prize Availability: In the event that the Prize is unavailable for any reason at any time, the Promoter reserves the right to substitute the Prize with another prize of equal value and the Prize Winner/s will be notified accordingly.

(e)   The Fisher & Paykel appliance prize is awarded to the winning bake club, not the individual baker. It is up to the club to decide how the prize is to be shared. The prize may not be sold for profit within 12 months of receiving it.

Section 6: Prize Winners

13.  Contact: The Promoter will announce the Prize Winners at the Wellington Bake Off 2011 on Thursday 18 August 2011 to confirm his/her eligibility under these Terms and Conditions and to confirm whether the Prize Winner/s wishes to claim his/her Prize. The name of the prize winners may be published on the New World website, Visa Wellington On a Plate website, Facebook, Twitter or other related promotional channels.  The winner may also be contacted by Foodstuffs (Wellington) Co-operative Society Ltd’s agency for further PR opportunities where they are agreeable.

14.  Claim of Prize: If the Prize Winner/s wishes to claim their Prize, the Prize Winner must confirm this fact and his/her eligibility to win under these Terms and Conditions within 48 hours of contact. If the Prize Winner fails to do either or both of these things by the deadline, the Prize Winner will be deemed to have forfeited the Prize.

15.  Re-judge: In the event that any Prize Winner forfeits the Prize or a Prize remains unclaimed, the Promoter will award the prize to the runner up of the Wellington Bake Off 2011 event, following the same procedure and format as set out under Section 4 above.

16.  Winner Publicity: In accepting the Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter.  The Prize Winner further acknowledges and agrees that the Promoter reserves the right to publicise their names, addresses and photographs in respect of this Promotion without any payment being made to them.

Section 7: General Conditions

17.  Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.

18.  Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winner, release the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion.  The Promoter, their related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this Promotion, the implementation of this Promotion, or the use of any prize, except for any liability which cannot be excluded by law.  Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion.  The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

19.  Force Majeure: The Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter and subject to State legislation the Promoter reserves the right to cancel, terminate modify or suspend the Promotion.

20.  Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.
